"Reasonably safe condition" standard

Legal Framework, Liability & Claims
"Reasonably safe condition" standard The legal benchmark for sidewalk maintenance in New York City: the sidewalk must be kept in a condition safe for ordinary pedestrian use, judged by what a reasonable owner would do, not by perfection.

Section 7-210 requires abutting owners to maintain sidewalks in a reasonably safe condition, and courts flesh out the phrase case by case. It does not demand a flawless surface; minor irregularities may be tolerated under the trivial defect doctrine, while raised flags, large gaps, missing pieces, and slippery accumulations fall short of the standard. Juries consider the defect's size, visibility, location, and foot traffic. DOT's defect definitions under § 19-152 give owners a practical checklist, since a sidewalk that would pass DOT inspection is usually well inside the reasonable-safety line.
